ClickWinner participation terms

§1 Organiser

The organiser is WERBUNGMACHER.DE UG (haftungsbeschränkt), Bahnhofstraße 13A, 77767 Appenweier, Germany. You can find all details in the imprint.

Apple and Google are not sponsors of ClickWinner, do not support it and are not affiliated with it.

§2 Taking part

  • Taking part is free and the same for every account, whatever the plan.
  • Natural persons aged 18 or older who live in the European Union may take part.
  • You need a ClickOnB.io account with a confirmed email address and completed setup.
  • You take part by confirming in your account (web or app) that you are 18 or older and live in the EU, and by accepting these terms in the version shown.
  • Each account has one chance per draw. Each person may only use one account (see the terms of service).

§3 Exclusion

The following cannot take part:

  • staff of the organiser,
  • multiple accounts of one person,
  • accounts that manipulate participation, for example through automated sign-ups,
  • accounts that break these terms or the terms of service.

An exclusion can also happen after a draw. The next reserve then takes the place (§5). If you think an exclusion is wrong, contact support. We reverse an exclusion made by mistake.

§4 Start and draw

  • The first draw only takes place once at least 100 accounts take part. Until then ClickWinner shows the current count.
  • We will announce the entry deadline and the date of the draw here before the start.
  • The draw covers all entries confirmed before the entry deadline that are still valid at the time of the draw.
  • The draw is random: a random seed from a cryptographic random number generator sets the order of all entries. The first entry wins, the following ones are reserves in that order.
  • The seed, the participant list (profile IDs only) and its checksum are recorded, so the result can be verified.
  • There is exactly one draw per period and it cannot be repeated. No draw takes place during a pause.

§5 Prizes, notification and response

The prizes will be announced here before the start.

The person drawn is told by email to the address of their account and in their account (web and app). They respond by replying to that email within the deadline stated in the notification. If they don't respond in time, decline or are excluded, the next reserve takes the place and is notified in the same way.

§6 Publication

We never publish real names. The person drawn is only named, for example with an award on their own page, with their explicit consent, which they can withdraw at any time. Without consent we only state the period, the date and the number of participants.

§7 Ending participation

You can end your participation in your account at any time. This applies to all later draws. Draws that have already taken place stay unchanged. You can take part again later while ClickWinner accepts entries.

§8 Privacy

For your entry we process both confirmations, the version of these terms, the times of joining and leaving and, if applicable, an exclusion reason as a fixed code. The draw record only contains profile IDs, no names. The purpose is running, documenting and notifying the draw. The legal basis is carrying out your participation (Art. 6(1)(b) GDPR). We will state the retention period when these terms are released. Your data export contains your entry and your entries in draws. See the privacy policy for more.

§9 Pause, changes and end

We may pause or end ClickWinner if it can't be run properly for technical, organisational or legal reasons. A new version of these terms only applies to you once you confirm it. Until then your entry does not count.

§10 Final provisions

German law applies. Mandatory consumer protection rules of the country where you live remain unaffected. If individual provisions are invalid, the rest remain valid.
